Motorcyclist critically injured in highway collision with car

Motorcycle riders and passengers in Massachusetts and other states know that their vehicles offer significantly less physical protection than do passenger cars and trucks. However, the rules of the road are essentially the same, and all drivers are responsible for following safe driving practices and all relevant highway rules and regulations.Unfortunately, this may not have been the case in a recent motorcycle accident that occurred on Route 202 between New Salem and Shutesbury. According to the Massachusetts State Police, the late-afternoon accident critically injured the unidentified motorcyclist, who was taken by air to a hospital in Worcester. The driver of the other vehicle involved, a Mazda passenger car, apparently was not injured.Investigation of the accident scene closed down a stretch of the highway for nearly 5 hours. The cause of the accident, however, has not yet been established by police, and no charges have been filed.An accident involving a motorcycle and an automobile could have been caused by either the driver or the motorcyclist. Regardless of who may have been responsible, the chances are that a motorcycle driver is more likely to suffer severe injuries or be killed because motorcycles offer far less protection than other vehicles.Massachusetts law requires motorcyclists as well as automobile drivers to carry liability insurance that ensures compensation for vehicular damage. The cost of treating severe injuries, however, must be borne by victims and immediate family members unless the other party was clearly at fault.In this case, the victim or family members may wish to consult an experienced attorney on what remedies are possible under the state’s civil statutes once the police have completed their investigation and determined whether the car driver was responsible for causing the accident through some act of negligence or whether it occurred because of other factors.
