One driver facing DUI charge after Massachusetts two-car crash

Barnstable, Massachusetts, residents would agree that drivers need to be extra cautious while driving at night. With the horrid weather and limited visibility, any form of distraction while driving can easily have dire consequences for the driver of the car and other passengers and victims involved in the accident. The problem is even more serious if the distraction is self-inflicted by the driver by operating under the influence of alcohol.In a recent car accident involving two cars, a negligent driver was arrested after the accident she caused sent a minivan with four people, including three children, into a pond. According to police, the negligent driver, a 21-year-old woman, also had a three-year-old child in her car at the time of the accident. The victims in the minivan were rushed to a hospital and were reported to be in stable condition. The child in the negligent driver’s car was in a car seat and was properly restrained. Thankfully, the toddler was not injured in the accident. According to police, the woman was driving under the influence of alcohol and will face charges for OUI, Child endangerment and failing stop or to yield.Fortunately, none of the victims suffered any major injuries in the accident but it could have been much worse. In the event of an accident like this, a victim has the right to sue the negligent driver for the driver’s irresponsible behavior. They may claim compensation for medical expenses, lost wages due to absence from work resulting out of an injury, pain and suffering and damages to the car.However, challenging the negligent driver, or even insurance companies, for that matter, after an accident is not always an easy task for the victim, considering the fact that the victim may not be in the best of health and spirits. Therefore, people should make sure they fully understand their legal rights before making decisions.
